Hmm.. "may be a survey..., has been approved"... not much in there to say how long for or why? I think a little more info would be the respectful thing to provide, given thae inconvenience it's causing.

Just checked my garage and the Microlight is missing!

Acea,not had my invite yet to Baas menu's of the week. However, she did inform me on a previous post that she was at "altitude". Maybe "high" or in the plane.

I had a call from a resident about the plane, which is clearly causing sleepless, or at least interrupted, nights for many on the Island and in the area.

He, too, has been attempting to find out about the plane from all the authorities and airports etc, so far without success.

I put him onto Hayling East Ward Councillor Dave Collins, as it seems to be affecting this Ward in particular and he has the Environment Portfolio, which is probably the one best to deal with this.

Will let you know if I hear anything further.

This is what I received from the CAA. Better buy some earplugs!

"Thank you for your enquiry via the online form regarding an aircraft flying over your location during the night.

The Civil Aviation Authority (CAA) is not directly involved in the provision of air traffic control services nor is it responsible for monitoring individual aircraft movements. However, this section has received a number of enquiries and complaints about this particular activity and our investigations have confirmed that the aircraft in question belongs to 2Excel Aviation Ltd. The aircraft is conducting a task on behalf of the Defence Science Technology Laboratory (DSTL), which involves carrying out various orbits within a 3 nautical mile radius of Thorney Island; it is intended to take place every night (providing the cloud base is not below 2,000 feet) up until the 28th January. The aircraft is flying between 2,000 and 4,000 feet and therefore is not operating in breach of the low flying prohibitions as detailed in the Rules of the Air Regulations (RoA) (these are summarised on the attached environmental information document); therefore the activity is entirely legitimate and consequently the CAA is unable to intervene. Further information on each of the organisations involved in this task, including their contact details, can be accessed through the following websites:

Whilst I completely appreciate the disturbance that is being caused, aircraft noise is not a statutory nuisance in the UK; it is not covered by the Environmental Protection Act or the Noise Act, therefore preventing a local authority from being able to act on aircraft noise issues. The CAA, as the UK's independent aviation regulator, does not have the legal power to prevent aircraft flying over a particular location or at a particular time for environmental reasons (except when considering proposals to establish new, or amend existing Controlled Airspace, which is not a factor in this case). Section 76(1) of the Civil Aviation Act 1982 states the following:

“No action shall lie in respect of trespass or in respect of nuisance, by reason only of the flight of an aircraft over any property at a height above the ground which, having regard to wind, weather and all the circumstances of the case is reasonable, or the ordinary incidents of such flight, so long as the provisions of any Air Navigation Order have been duly complied with.”

There are no time restrictions in place for the use of UK airspace - it can be used 24 hours a day. The CAA is tasked by the Government to provide a focal point for aviation related environmental enquiries and a summary of your complaint will be logged onto our complaints and enquiries database.
